To be quite honest, I do not feel that The Spa Specialist has given me
 a good value for my dollar, or even a fair one. What started out as a
 botched installation on a spa with some damage has cascaded into a
 malfunctioning spa that isn't even what I ordered in the first place.
 If this were a car purchase, I'd be at the dealer and we'd be having a
 nice conversation on how much of a tax writeoff the dealer wants in
 order for me to not return the car and find some other dealer to
 patronize. I expect you would do the same.


If I understand your proposal correctly, you'll be crediting the
 $4,695 outstanding until the right spa is completed and you and/or Jim
 deliver and install it, upon which time you'll re-bill me for the
 $4,695. This is not acceptable to me. Not to mention redundant from my
 point of view, since I had MasterCard put a hold on the remainder of
 the payment.


Due to of all of the issues with this spa, I've revisited my original
 options on which spa to purchase, including buying a Phoenix branded
 Coronado from a dealer down in Federal Way, WA. The other two options
 I was looking at would cost me approximately $7,000. I went with The
 Spa Specialist which ran me $9,380, a $2,380 premium, because I
 believe in supporting small businesses and emerging online ventures
 and value good customer support very highly. However, the customer
 support hasn't been there, and this spa is _causing_ me stress as
 opposed to relieving it.


Therefore, here are three options:


1) Lower the price from $9,380 to $7,000. Have the proper spa built,
 delivered, and installed. Upon successful installation, I'll pay an
 additional $2,305, bringing the total price to $7,000. This will turn
 me into a satisfied customer who will want to continue doing business
 with you, and give The Spa Specialist / Van Dyke Trucking / Phoenix
 Spas $2,305 to write off their '00 taxes.


2) Credit my account the $4,695, have the tub repaired, and walk away.
 I'll keep the spa I currently have, and you get a bigger tax write-off.


3) Credit my account the full $9,380 and have the spa removed. As I
 had asked last week to either have it fixed or removed by today (Sat)
 and cannot put in a working spa until this one is removed, I will
 begin to charge a storage fee of $20 per day starting tomorrow until
 it is removed.


 Please let me know which option you'd like to pursue. It may also be
 more of a time-saver to call me: (206) 517-3039 to fully hammer this

My (Jim Arjuna) notes about this:   When people start out with "to be quite honest" it means they have not been honest up to that point, so why should anyone believe them now.  When someone orders anything and accepts the price for the item, that is it.   There is no negotiation after the order and the acceptance, except that Erik was planning this scam all allong, it is something the sciociopaths and just plain thieves do.  Erik's spa was taken back and we gave him all his money back.  He kept a bunch of items, like the GFCI and the chemicals that were never returned to us.   This guy is a real fool and a disgusting example for his children.  I hope that his children get to read all of this, ( I intend to send it to them when they grow up, so they can see a part of the "old man" that they don't know about.) so they don't follow in Erik's footsteps and ripoff hard working people.

 The Super Custom Fallsburg is not a Phoenix Coronado it even has it's own ETL listing.    It is a totally customized spa with extremely powerful therapy. 

Do you see anywhere in his demands that he is happy to get a new replacement spa as we offered him?  It is a carefully concocted story that has not one ounce of truth in it.  Some people who think they are smart will do anything to rip off another person.   He purposely sabotaged the spa, then called the credit card company.

He told me that he had screwed a car dealer out of all his profits on a car for his fiance.  Get this he told me that she got a car with upgrades from what she ordered, and he still go a refund because it was not the car that she ordered.  I still can't believe he told me that.  I guess he figures he can steal from anyone if he treatens their business.
 (He seems to be good at extorting from merchants and for some reason he is never satisfied with the service.)
Can you imagine the audacity to ask us to leave an extremely expensive high end  spa at his house for $4695.00??   That is an insult to all the people who worked so hard to produce it.

 I wonder how many free meals he gets by raising hell in the restaurants over perfectly good food?  You know the type?  What we call a cheap bastard, commonly.
What they really want is the food for free and all they have to do is be a jerk.

The Super Custom Fallsburg is by far the highest end product made today.  There is no spa made with even close to the specifications nor the advanced design and engineering.

Often times these con artist will pose as victims to hide the intentions.  What sort of person keeps a journal of his events on a spa purchase, in order to use that to threaten the merchant with?   He planned this all along, from the moment he asked for the "text email" in the first emails back and forth from him (see below). I should have figured he was up to something.  I have never since had anyone ask to format email for them.

Here is the real meaning in my sarcastic and hopefully humorous rhetoric:

We have been in business for  nearly 10 years, we are in the thousands of Haven Spas delivered all across the US, and because of our customer service, we have had only two difficult customers who tried to rip us off.   The other one was a guy named Andy who bought a used spa from me and tried the credit card scam to get a brand new Super Custom Fallsburg.  Can you imagine how these guys got this way?  Their parents should be ashamed of them.  They are an embarrasment to their families.

If I bought a used spa with the knowledge that there is no refund on a used spa, then called the credit card company for a refund, my dad would turn over in his grave.  I was taught to be honest and to not steal.  These guys will do whatever is necessary to rip off anyone that they do business with.  I personally went to Andy's home and checked out the used spa he bought from top to bottom, and there was nothing wrong with it except an air injector that was blocked with silicone.  I unblocked the air jet and left.  I took photos.   This is a whole other story.  We sent our service tech 200 miles out of his way to go and fix all the damage that Andy did to the spa when he left the stereo door open and put in pool chemicals in the spa.  When we sent out the new wood pieces, he refused to accept them, because he was working the scam.

Dear Jim,

 

This document is intended to be used as an affidavit to put to rest any implied or fabricated statements which may have been made by other parties concerning the above hot tub, which I have owned since I picked it up in Alabama in January of 2002. 

 

Overall, the spa was in pretty good shape, with the following exceptions: 

 

The heater union nuts were broken, obviously from freeze damage.  The wall fittings and topside valves were discolored as would be caused by tri-chlor, which should not be used in spas.  There were some minor cuts in the cover.  I have pictures to document all these details. 

 

Upon replacing the union nuts, I filled the spa and put it into operation.  It has been in use ever since, with no major problems, just normal maintenance.  It has been a quiet, powerful dependable hot tub, which I am happy to have.  It is better designed and built than any other spa I have seen.  The plumbing is sensible, and the “two by four” framing and superior insulation make it strong and energy efficient.

Kenny Johnson has been in the pool and spa industry for now 25 years.  He is one of the best and most masterful spa repair people I have ever met.

The Spa that Andy tried the credit card scam on us, is the same one that
Kenny now owns since 2002.  How is it that the only issues with the spa were caused by Andy's misuse of pool chemicals in the spa and then disconnecting the power in winter on it to cause freeze damage. Plus he let rain water into the stereo.  Another cheap bastard trying to scam us using the credit card company.
We sent Andy a bill for the shipping, delivery fees and for the damage he did to the spa to get it fixed, over $2,000.   He got pissed off and sent email to our competitors who hate our ethical stance and
then this sociopath Erik publishes this.   I am not concerned about Erik or Andy, because I know that God will take care of them and teach him the lessons he needs.  I have never found that God's laws to be something to play with.  I just don't believe in letting people like Erik and Andy get away with their lies and deception.  They are disgusting people to me and I don't want anything to do with anyone who even comes close to those cheap fools. The credit card companies are not so quick to offer refunds these days and you can go to jail for fraud and be suied if you try it now.
